K1MAN COURT BATTLE WITH THE FCC HAS OFFICIALLY BEGUN - CASE LAW

Dear Ms. Simmons:

This will respond to your Certified letter 7003 0500 0000 9846 3818 to me dated 25 July 2005 indicating that my recently granted renewal application for K1MAN with the new expiration date of 10/17/2015 has now been "set aside" per Rule 1.113(a).

My legal position is that the Commission has thus intentionally and illegally violated my constitutional rights of due process by, de facto, not renewing my timely filed renewal application, in which case, I could continue to operate K1MAN indefinitely until the Commission makes its final adjudication of the renewal application which would, of course, be appealable to the D.C. Court of Appeals and then to the United States Supreme Court where this quite obvious constitutional deprevation [SIC] issue would be finally decided, if necessary.

Of course, the Commission is attempting here to break new ground in the still evolving field of administrative law, and I feel truly honored to be a part of this very important new case law process.

This will serve notice to the Commission that I will continue to operate K1MAN indefinitely based on the above legal grounds.

It brings to mind the old adage,

"He who acts as his own attorney has a fool for a client"

Given the wording of his paranoid delusional letter, and the "deprevation" of his cortical neurons, it looks pretty clear that he'll be frothing at the mouth and speaking in tongues when they haul him away in a canvas jacket  :badgrin:

I don't know if I'd call it a court battle right now.  To me it's a onesided pissing match and FCC is holding a big specimen cup.

Of course, the big question is who will get/want the K1MAN callsign when it becomes available.

I wondered about that, who gets the call sign. I'd hope its someone
who wanted his unwanted butt off the air.   Anyone know the rules?
I'd take it long enough to say - don't let the hamshack door hit
you in the ass on the way out! - I wonder if Chuck has applied for
it Frank? ;; is there a way to pass a call to another ham? maybe
we all apply for it, if one of us gets it then pass it to Chuck - that
is if he really wants it . . :)

Actually the first breach of the fence was behind a hot dog stand that was declared a rip off....I simply walked in....later the whole fence was trashed.... I did not get served breakfast even after the sun came up Sunday morning....

 Did you get through without slicing your feet up..I hope so, um, ya know the day that Wavy Gravy Passes the country should come to a complete stop and Bow.... The man and the hog farm "pranksters" did alot for the common good... that Brother Saved the day...i wonder if he's still amoung the living...

Don't know for sure if he's still alive...but at least I've seen Jimmy, Janis, Keith Moon.....and if I had to pick the best act of the weekend it was the Who. Satin wizard outfits doing Tommy.....destroying their gear LIVE thru all 144 speakers.....

there is an organized anniversary gathering (small) and I think now you can find info on the web...people go that didn't make the first. I went to two unofficial anniversaries, it was at the 20th there was a total lunar eclipse directly over thew stage.....met a girl there that was told by her parents she was conceived at the original concert. Cute thing that liked the 'older' guy <hehheh>.

I am positive I am the ONLY 60's relic  to MISS woodstock. HONEST! I never got to it...

Was sweating out the draft and had to w-w-work).

Lost to the draft (!) and screwed up the job.

Last count I think there were about 975,000 kids conceived at the original.

According to my son,  Wavy Gravy is still around... got to research into this.

Imagine if W-69 were duplicated with the original folks?  Walkers, scooters, metamucil, Flomax, Lisinopril,  etc you get the picture !

keep smiling... and stay away from the brown tabs...

Ahhhhhh....the anniversaries.  Which other besides '89 were you at.  IMHO, '94 and '95 were the best.

Yes, Virginia, you can still experience the experience.  I've been there lots, the people hosting it, Roy and Jeryl, are about as close to saints as I'll ever know, and it still happens every year.  Ignore any rumors that it won't.  Best info is at that site and at the BBS there.  Or, you can email them, the address in on the contacts page.  

I highly recommend it, it's always a grand time.  If you go, please let me know,  I'll supply whatever info you might want to know; plus, it'll convince me I should go again this year, I've missed the last 2 or 3 for no good reason.

And you can learn all about small town Sullivan Co., NY politics.

It's not at the original site anymore...thanks to a guy named Alan Gerry, it's now on the land surrounding Max Yasgur's farmhouse.  It's easy to find, Yasgur Rd is just off 17B about 15 miles, more or less, from the Quick way.
