Dear Ms. Simmons:
This will respond to your Certified letter 7003 0500 0000 9846 3818
to me dated 25 July 2005 indicating that my recently granted renewal
application for K1MAN with the new expiration date of 10/17/2015 has
now been "set aside" per Rule 1.113(a). My legal position is that
the Commission has thus intentionally and illegally violated my
constitutional rights of due process by, de facto, not renewing my
timely filed renewal application, in which case, I could continue to
operate K1MAN indefinitely until the Commission makes its final
adjudication of the renewal application which would, of course, be
appealable to the D.C. Court of Appeals and then to the United States
Supreme Court where this quite obvious constitutional deprivation
issue would be finally decided, if necessary.
Of course, the Commission is attempting here to break new ground in
the still evolving field of administrative law, and I feel truly
honored to be a part of this very important new case law process.
This will serve notice to the Commission that I will continue to
operate K1MAN indefinitely based on the above legal grounds. If
